To answer the first question in Case Illustration 10-9, the counselor reviews B.1.c. (Respect for Confidentiality), which reinforces his decision to protect his clients’ confidentiality. Clearly the answer to this question is negative. At the beginning of every couples counseling session, Michael reviews B.1.d. (Explanation of Limitations) and reminds the couple that he will respect confidentiality as long as they do not make a threat to harm themselves or others. Even though Michael understands that B.2.a. (Serious and Foreseeable Harm and Legal Requirements) allows him to “break confidentiality to protect clients or identified others from serious and foreseeable harm or when legal requirements demand that confidential information must be revealed,” he knows that in his state, professional counselors are mandated reporters for incidents of child abuse, but they are not mandated to report issues between two adults.

To find the answer to the second question, Michael again follows the suggestions in B.2.a. (Serious and Foreseeable Harm and Legal Requirements) directing him to “consult with other professionals when in doubt as to the validity of an exception.” He consults with several other counseling professionals at his agency and comes to the conclusion to maintain the confidentiality and continue working with José and Claudia in couples counseling.

For the third question Michael believes this violent incident was isolated and will not be repeated as the couple continues in therapy. But as a precautionary measure, he shares with Claudia a list of resources:

With an immediate threat or emergency, 911 or local emergency lines

With no immediate danger: National Domestic Violence Hotline

Local hospital or crisis center

Local court to help with a court order of protection
